METHOD AND TERMS
Bidding will be on a per acre basis on Tracts 1, 2, 3, 5, 6, 7, 8, 9 & 10. Bidding will be for the total dollar amount on Tract 4.
Ten percent (10%) of the bid price to be paid on the day of sale with the balance due at closing, which will be on or before December 12, 2011.
Buyer(s) will be delivered a merchantable abstract and deed at the time of closing. Possession at the time of closing subject to a farm lease which ends February 28, 2012. Buyer(s) will be granted fall tillage rights upon removal of the crops. The buyer of Tract 4 will receive full possession of the house and garage at the time of closing.
Real Estate taxes shall be prorated to the date of possession on the basis of the last available tax statement and all prior real estate taxes will be the responsibility of the Sellers. All subsequent real estate taxes will be the responsibility of the Buyer(s). Immediately following the auction, the successful buyer(s) shall enter into a written agreement with the seller. Sale procedure: Tracts 1 & 2 will be sold first through the marketing method of "Buyers Choice", whereas the high bidder can purchase Tract 1, Tract 2 or both Tracts 1 & 2 for their high bid. If the high bidder elects only one of the two tracts, the remaining tract will then be sold.
Tract 3 will be sold next followed by Tract 4.
Tracts 5, 6, 7, 8, & 9 will then be sold through the marketing method of "Buyers Choice", whereas the high bidder can purchase (in any order) any or all of Tracts 5, 6, 7, 8, & 9 for their high bid. "Buyers Choice" auctioning will continue on Tracts 5, 6, 7, 8 & 9 until they have all been purchased.
Tract 10 will be sold last.
