PROVISIONS

- This real estate is selling subject to public road easements and all other easements of record.
- It shall be the buyer's responsibility of Tract 1 to show proof of purchase to the Des Moines County FSA office so that he/she will receive any possible future government program payments.
- It will be the buyer's responsibility for all fencing on Tract 3, all other fence lines shall be governed by the State of Iowa as well as Des Moines County fence line rules and regulations.
- Tracts 1, 2 & 3 are being surveyed by a registered land surveyor at the seller's expense, those tracts will be sold based on surveyed acres.
- It will be the responsibility of the buyer to update the septic system according to the rules governing in Des Moines County. Buyer will be required to sign a Time of Transfer Inspection Waiver Binding Acknowledgement for Future Installation at the time of closing of the real estate. Buyer will be required to apply for a Disposal Installation Permit with the Des Moines County Sanitarian and agree to complete the work within 120 days of closing on the property.
- Sellers will deposit $8,500.00 into an escrow account towards the installation of a new septic system on the day of closing of the real estate.

METHOD AND TERMS OF SALE

The acres advertised on this auction flyer are estimated. A survey will be completed prior to sale day. Tracts 1 & 2 will be sold on a price per acre basis using the marketing method of "Buyer's Choice," whereas the high bidder can purchase Tract 1, Tract 2 or both Tracts 1 & 2 for their high bid. If the high bidder elects only one of the two tracts, the remaining tract will then be sold. Tract 3 will be sold for a lump sum sale price.
Ten percent (10%) of the final bid price to be paid on the day of the auction with the balance due at closing which will be on or before December 23, 2011 upon delivery of merchantable abstract and deed. Immediately following the auction, the successful buyers shall enter into a written agreement with the seller. The real estate taxes will be prorated to the date of closing on the basis of the last available tax statement and all prior taxes. Possession on all three tracts will be given at the time of closing.
