METHOD & TERMS
Bidding on all tracts will be on a price per acre basis. The acreages in this advertisement on Tracts 4 - 15 are estimated. A survey on Tracts 4 - 15 will be completed prior to the auction with the acreages obtained from said survey being used to calculate the final settlement price.
The buyer(s) will be required to pay a non-refundable down payment sale day. Down payments required are as follows: Tract 1 - $50,000.00; Tract 2 - $20,000.00; Tract 3 - $17,500.00; Tract 4 - $35,000.00; Tract 5 - $35,000.00; Tract 6 - $70,000.00; Tract 7 - $70,000.00; Tract 8 - $50,000.00; Tract 9 - $60,000.00; Tract 10 - $60,000.00; Tract 11 - $55,000.00; Tract 12 - $20,000.00; Tract 13 - $20,000.00; Tract 14 - $35,000.00; Tract 15 - $35,000.00.
The balance of the purchase price will be due at the time of closing, which will be on or before December 29, 2011.
Possession will be given at the time of closing. Possession on Tract 3 is subject to a hunting lease which expires March 1, 2012. Real estate sells subject to easements of record.
The 2011 real estate taxes will be paid by the seller. Title Insurance in the full amount of the purchase price will be provided.
Seller may terminate the auction after sales aggregating sufficient net proceeds to pay the Secured Creditors in full is met. All prior sales to any termination point are irrevocable and without reserve, subject only to court approval.
Immediately following the auction, the successful Buyer shall enter into a written contract with the Seller. Said contract maybe inspected prior to the auction by contacting the Seller's Attorney.
