LOCATION

The Miller Farm is located in Sections 3 & 4, Washington Township, Van Buren County, IA. At the north edge of Keosauqua, IA on St. Hwy. 1 go north 5 miles to the St. Hwy 16 East. Turn left or east on St. Hwy. 16 and proceed 2 miles to the farm. (Be watching for presale directional signs.)

METHOD & TERMS

The Miller Farm will be sold in 7 individual tracts, based on a survey that is currently in progress with said surveyed acres being used to constitute the final settlement price. Tracts 1 – 6 will be sold on a price per acre basis through the marketing method of “Buyer’s Choice” whereas the high bidder can elect (in any order) any or all 6 tracts for their high bid. Buyer’s Choice auctioning will continue until all 6 tracts have been sold. Tract 7 will be sold last for a Lump Sum, total dollar amount. The tracts will NOT be offered in their entirety or in any combinations at the conclusion of the auction.

Ten (10%) percent of the bid price to be due on the day of sale with the balance due upon delivery of a merchantable abstract and deed. Closing is scheduled to be in approximately 45 days, on or before Monday, January 7, 2019. Immediately following the auction, the successful bidder shall enter into a written agreement with the seller. The real estate taxes will be prorated to the date of closing. Possession will be given at the time of closing on Tracts 1 – 6, subject to the removal of the crop for the 2018 crop year. Full possession will be given on Tract 7 at the time of closing. SPECIAL PROVISIONS

  • This real estate is selling subject to public road easements and all other easements of record.
  • All fences and fence lines shall be governed by the Van Buren County and State of Iowa fence line rules and regulations.
  • It will be the responsibility of the new buyer(s) to show proof of purchase to the Van Buren County FSA Office so that he/she will receive any or all future government payments including the prorated share of the CRP payments on Tract 6. It will be the responsibility of the buyer to comply to said CRP contracts and hold the seller harmless of any damages due to failure of any contract specifications.
  • If any access driveways are needed, said driveway installation & costs will be at the buyer(s) expense.
  • Subject to the Iowa Septic System “Time of Transfer Law” the septic system that services the home on Tract 7 will be required to be updated. Any septic system testing or upgrading expense will be the buyers responsibility.
  • The tenant (Mike Kisling) was served lease termination prior to September 1, 2018.
  • If in the future a site clean up is required, it will be at the expense of the buyer(s).
