Method & Terms

The real estate will be sold on a price per acre basis, based on 66.97 taxable acres.

Immediately following the online public auction, the successful Buyer/bidder shall enter into a written auction sale contract with the Seller and shall pay ten percent (10%) of the purchase price as a non-refundable down payment which will be held in escrow by the title company until closing. The balance of the purchase price will be due and payable by Buyer at closing which will take place on or before January 13, 2023. The Seller will provide an owner’s title insurance policy in the full amount of the purchase price.   Seller to give a credit at closing to Buyer for year 2022 (due/payable in year 2023) real estate taxes based on the latest available information.  Buyer shall pay year 2022 and subsequent years’ real estate taxes.  Seller will tender an executor’s/trustee’s deed to Buyer at closing.  A copy of the auction sale contract and title insurance commitment are available for inspection.   The real estate is offered for sale AS IS.  If Buyer defaults on the auction sale contract, Buyer shall pay Sullivan’s fees/expenses and Seller may pursue an action against Buyer. Possession will be given at closing subject to the current tenancy for the 2022 crop year only. Open tenancy for 2023 and beyond.

Bidding is NOT subject to any contingencies, including but not limited to financing, an appraisal or inspection of the real estate.
