The Moore Farms are located in Section 35 of Yellow Springs Township, Sections 1, 2 & 11 of Franklin Township and Section 6 of Benton Township, Des Moines County, Iowa. Tracts 1 & 2 are located at the south edge of Mediapolis, Iowa, along Hwy. 61. Tracts 3, 4, 5 & 6 are located approximately 2 miles south of Mediapolis, Iowa (Tract 3 is along Hwy. 61 and Tracts 4, 5 & 6 have access along the east off 115th Ave). METHOD & TERMS

The Moore Trust Farm will be sold based on the above surveyed acres. Said surveyed acres will be used to calculate the final settlement price. All nine tracts will sell on a price per acre basis, based on the final surveyed acres. All nine tracts will be offered through the marketing method of “Buyer’s Choice,” whereas the high bidder can elect (in any order) any or all tracts for their high bid. Buyer’s Choice auctioning will continue until all tracts have been sold. The farm will NOT be offered in its entirety at the conclusion of the auction. Bidding is not contingent upon obtaining financing.

Ten percent (10%) of the bid price will be due on the day of the sale with the balance due at the time of closing and upon delivery of merchantable deed and abstract. Closing of all tracts is scheduled to be on or before December 5, 2016. Immediately following the auction, the successful buyer(s) shall enter into a written agreement with the seller. Real estate taxes will be prorated to the date of closing, based on the last available tax statement. Possession will be given at the time of closing subject to the current farm lease. Farm sells free and clear for the 2017 crop year.

SPECIAL PROVISIONS

  • This real estate is being sold subject to public road easements and all other easements of record.
  • All fences and fence lines shall be governed by the State of Iowa and the Des Moines County fence line rules and regulations.
  • It will be the responsibility of the new buyer(s) to show proof of purchase to the Des Moines County FSA Office so that he/she will receive all future government payments, including the prorated CRP payment on Tract 2. Buyers will be required to abide by all CRP contracts and hold the sellers harmless of any default of said contracts.
  • The tenants were served Lease Termination prior to September 1, 2016, with said Lease ending March 1, 2017.
  • All personal property will be reserved for the tenant, including cattle equipment and feeders located on Tract 6.
  • If in the future a site clean up is required, it will be at the expense of the buyer(s).
